Halcyon Digital - 3D Digital Design Agency
1. Services
Halcyon Digital will provide subscription-based design services ("Services") as outlined in the client's chosen subscription plan. Specific deliverables and project scope will be agreed upon at the start of each project.
- Halcyon Digital may engage subcontractors, freelancers, or other personnel as needed to deliver the services. All such personnel are bound by confidentiality obligations equivalent to those in this agreement. Halcyon Digital remains the client's primary point of contact and is responsible for the quality of work delivered.
- Work outside the scope of the active engagement, including additional service categories not listed in the engagement summary, may be undertaken at Halcyon Digital's sole discretion under a separate written engagement or change order. Pricing for additional work is determined at the time of agreement.
2. Payment
- Subscription fees are due in advance on a recurring basis as per the client's chosen billing cycle.
- Failure to make timely payments may result in suspension or termination of services.
- No refunds will be issued once work on a project has commenced.
- Subscription fees will not be charged during the pause period.
- Pricing for each engagement is set at the time of agreement. Prior or current pricing creates no obligation for future engagements; rates may be adjusted at the start of any new engagement period.
3. Intellectual Property
- Halcyon Digital retains ownership of all project files, including source files, design concepts, and working drafts, unless otherwise agreed upon in writing.
- The client will own the final deliverables upon completion of the project and full payment of all fees.
- Halcyon Digital reserves the right to use all deliverables for promotional purposes, including but not limited to portfolio showcases and marketing materials.
4. Confidentiality
- Both parties agree to keep confidential any sensitive information shared during the course of the project.
- This confidentiality obligation will survive the termination of this agreement.
